The Dutch Operations Decree (Activiteitenbesluit) is complex. It is common for the authorities to impose requirements because they overlooked the possibilities for exemption, or for rules to be subject to multiple different interpretations. AAB seeks first to resolve the problem by talking with the authorities in question. Unfortunately, this does not always yield the desired result. In that case, AAB will go through the formal procedures and if necessary call in legal assistance. More than once the Council of State ultimately ruled in our client’s favour. Throughout these legal proceedings we repeatedly assess the chances of success and consider whether the effort and risks justify the desired outcome.
