According to the Dutch Activity Decree, every activity in The Netherlands which can be seen as “soil threat”, the quality of the soil has to be investigated. This obligation is applicable when starting, changing and ending a company.
The selling of a company will be seen as ending the company, also when another entrepreneur will continue the company on the same site. Thus, with the transfer of the property the soil condition has to be reported in a document, the so-called ‘eindsituatie’. Such an investigation can only be executed by a certified company according to the NEN 5740 norm.
